Question by Cissy M: Insurance agents only: For New Jersey auto insurance, what does “no limitation on lawsuit threshold” mean?
Does it mean one can sue in only a few cases, or does it mean that there are no limitations in what one can sue about?

(New Jersey auto insurance companies purposefully make this confusing, so I can’t really be sure which option is which.)

That means, there’s no limit, to suing for pain & suffering in an auto acccident. Regardless of how minor (or imaginary) your injuries are, you retain the right to sue the other guy, in the accident, for your injuries, and your pain & suffering. (Think, whiplash claims).

NJ has a verbal threshhold – that means, if you choose the cheaper coverage, the verbal threshhold coverage, AND, you’re in an auto accident, caused by someone else, you can ONLY sue the other person if you have one of the following:

Type 1 – death
Type 2 – dismemberment
Type 3 – significant disfigurement
Type 4 – a fracture
Type 5 – loss of a fetus
Type 6 – permanent loss of use of a body organ, member, function or system
Type 7 – permanent consequential limitation of use of a body organ or member
Type 8 – significant limitation of use of a body function or system
Type 9 – a medically determined injury or impairment of a non-permanent nature which prevents the injured person from performing substantially all of the material acts which constitute that person’s usual and customary daily activities for not less than 90 days during the 180 days immediately following the occurrence of the injury or impairment.

The vast majority of injuries in auto accidents are “soft tissue” injuries – whiplash, neck aches, muscle strains. If you want to be able to sue for pain & suffering, for these types of injuries, you need to select the “no limitation” option. It will cost you more.
